These Terms and Conditions govern the download, access, and use of the mobile application LABORATORIO ECHEVARNE or LAB. ECHEVARNE (hereinafter, APPLICATION or APP), which LABORATORIO ECHEVARNE, S.A. makes available toUsers in order to offer our clinical analysis services.

 

1. GENERAL

In compliance with the general information obligation of Article 10 of Spanish Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, you are informed that LABORATORIO ECHEVARNE, S.A., registered in the Barcelona Mercantile Registry, Volume 5,526, Page 164, Sheet No. 63582, Entry 1, with NIF A08829848 and address at Calle Provença, 312 – bajos 08037 Barcelona (Barcelona), is responsible for the Application. Access to the APPLICATION implies that the user acknowledges having accepted and consented without reservation to each and every provision included in all the terms of this document. 

LABORATORIO ECHEVARNE, S.A. reserves the right to modify these Terms of Use in order to adapt them to the applicable legislation in force at any given time. Any such changes will be published in the APPLICATION and will be effective from the time of their publication. If you do not agree with updates to the Terms of Use, you may opt out by ceasing to use the Service. 

Access to and download of the application is free, except for the cost of connection through the telecommunications network provided by the access provider contracted by the User.

By using the APPLICATION, the User declares to be over 14 years of age. Likewise, LABORATORIO ECHEVARNE, S.A. reserves the right to request additional documentation from the User in order to verify this age. LABORATORIO ECHEVARNE, S.A. does not collect information from children under 14 years of age. If it is suspected that a user of the services is under this age (14 years), and has falsified the data required for access, LABORATORIO ECHEVARNE, S.A. may deny said user access to the Services offered. In any case, parents and/or legal guardians of minors must ensure compliance with this provision and are responsible for the acts of the minor. 

 

2. INFORMATION COLLECTION

2.1.- Collection of technical information:

The Application automatically collects the following information about the User's computing device: 

• Identity:  
  • Search for accounts on the device
  • Approximate location (network-based), precise location (network and GPS-based) 

 

• Others:  
  • Manage document storage
  • Interaction activity to conduct statistical studies of trends and product prescription. Activity regarding received leads, interactions, request status, etc., to have usage statistics aimed at improving the APP's features. 
  • Receive data from the Internet. 
  • Full network access. 
  • Prevent the device from going into sleep mode.

 

3. SYSTEM REQUIREMENTS AND AVAILABILITY

In general, prior subscription or registration as a User is required to access and use the APPLICATION. 

To use the Mobile APPLICATION, the User must have a compatible computer, phone, or mobile device with internet access and that meets the minimum software requirements listed below. 

The software requirements are as follows: Android 4.2 devices and higher; Apple devices with iOS 8.0 or later. 

The software version of the APPLICATION may be updated periodically to add compatibility with new features and services.

 

4. PRIVACY POLICY

LABORATORIO ECHEVARNE, S.A. is especially sensitive to the protection of the data of Users who access the APPLICATION, guaranteeing their privacy in accordance with the legal requirements stipulated in current legislation. 

When the User creates an account, LABORATORIO ECHEVARNE, S.A. collects personal information such as the User's name, email address, date of birth, gender, as well as any other personal information or preferences you enter into the Service. 

LABORATORIO ECHEVARNE, S.A. may also collect and automatically generate information from other areas of use, such as service metadata, data fromin ic iosession, device information, IP addresses, third-party data, and information obtained from cookies. 

In compliance with Regulation (EU) 2016/679 of April 27, 2016 and Organic Law 3/2018 of December 5, LABORATORIO ECHEVARNE, S.A. as Data Controller informs that it will process the data provided by the User through the APPLICATION form for the following purposes: 

• Manage registration as a registered User in the application in order to provide and maintain its services, 
• Resolve questions and doubts raised by the User through the mobile application 
• Periodically send (via email, postal mail, and/or SMS) electronic communications with offers, promotions, and news related to our application, unless otherwise indicated or the User objects or revokes their consent. 
• Contact the User for participation in quality surveys to improve the service. 

• Communicate with the User by email or regarding matters related to the Service 
• Prepare anonymous statistical reports regarding access habits and activity carried out by Users in the APP. 
• Manage payment transactions and shipment of purchased items. 

The data will be processed for as long as necessary to maintain the purpose of the processing unless the data subject has revoked their consent. Subsequently, they will be kept blocked to comply with legally established deadlines, adopting technical and organizational measures to prevent their processing, including their viewing, and being available only to judges, courts, the public prosecutor, or public administrations, in order to address legal responsibilities. After the required legal period, these data will be definitively destroyed. 

The User's data will not be communicated or transferred to third parties unless there is a legal obligation or to those providers linked to the Controller who act as data processors with whom the corresponding contract has been signed, in accordance with the terms of current legislation. 

Our servers are located in the European Union, and as a general rule, we contract service providers also located within the European Economic Area or in countries that have been declared to have an adequate level of protection. 

If we need to use external service providers that require the transfer of personal data outside the European Union or to countries that have not been declared to have an adequate level of protection, we will ensure the security and legitimacy of the processing of your data through adequacy decisions, standard clauses, binding corporate rules, exceptions, or any other instrument approved by the supervisory authority that offers adequate guarantees for the international transfer of data. 

The legal basis for processing your data and sending commercial information will be the consent given by the User by selecting the acceptance box for the information clause and our privacy policy before submitting the request. 

For its part, the management of contracting products or services through the application, corresponding billing, and shipments is legitimized by the execution of the contract itself. 

When we collect precise location data, after obtaining your consent, we process this data based on your prior consent. 

It is important that in order for us to keep personal data up to date, the user always informs us of any changes to them; otherwise, we are not responsible for their accuracy. The user guarantees that the personal data provided are truthful, ensuring that all information provided corresponds to the real situation, is up to date, and is accurate, and is obliged to communicate any modification. 

If the User provides data of third parties for any purpose to LABORATORIO ECHEVARNE, S.A., they guarantee that they have obtained this data lawfully, have previously informed the affected parties, obtained their consent to communicate them, and that the information provided is accurate and truthful. 

The User who provides data through the forms of this APP accepts its processing and, as indicated in point 1, declares to be over 14 years of age, with access and use by minors under this age prohibited. If at any time the Controller detects that a child under 14 has provided personal data, it will proceed to cancel them. Likewise, parents or guardians may in any case contact LABORATORIO ECHEVARNE, S.A. to block the access account of minors in their care who have registered by falsifying their identity. 

The User has the right to access their data and obtain confirmation about its processing, as well as a copy of the personal data being processed. They have the right to update them and request the rectification of inaccurate data or request deletion when the data are no longer necessary for the purposes for which they were collected. You may request the limitation of the processing of your data and object to their processing by revoking your consent, as well as exercise the right to data portability. Likewise, you have the right not to be subject to decisions based solely on the automated processing of your personal data. 5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The intellectual and industrial property rights over the APPLICATION are owned by LABORATORIO ECHEVARNE, S.A., which holds the exclusive right to exploit them in any form and, in particular, the rights of reproduction, distribution, public communication, and transformation.

Third parties holding intellectual and industrial property rights over photographs, logos, and any other symbols or content included in the APPLICATION have granted the corresponding authorizations for their reproduction, distribution, and making available to the public.

The User acknowledges that the reproduction, modification, distribution, commercialization, decompilation, disassembly, use of reverse engineering techniques or any other means to obtain the source code, transformation, or publication of any result of unauthorized reference tests of any of the elements and utilities integrated within the development constitutes an infringement of the intellectual property rights of LABORATORIO ECHEVARNE, S.A., and therefore undertakes not to carry out any of the aforementioned actions. 

Information about links
The APP may sometimes contain links to and from websites of our network of partners, advertisers, and affiliates (including, but not limited to, websites where the service is advertised). If the User follows a link to any of these websites, they should be aware that such websites and any services they may access through them have their own privacy policies and LABORATORIO ECHEVARNE S.A. does not accept any responsibility for them or for any personal data obtained by these websites or services, such as contact and location data. The User should review these policies before submitting any personal data to these websites or using their services.

 

6. DISCLAIMER OF LIABILITY

LABORATORIO ECHEVARNE, S.A. reserves the right to edit, update, modify, suspend, delete, or terminate the services offered by the APPLICATION, including all or part of its content, without prior notice, as well as to modify the form or type of access to it. 

Possible reasons for modification may include, for example, adaptation to possible legislative changes and changes in the Application itself, as well as those that may arise from existing codes of practice in the field or for strategic or corporate reasons. 

LABORATORIO ECHEVARNE, S.A. will not be responsible for the use of the APPLICATION by a minor under 14 years of age, with the download and use of the APPLICATION being the sole responsibility of the user. 

Responsibility for use of the APPLICATION lies solely with the User. Except as provided in these Terms and Conditions, LABORATORIO ECHEVARNE, S.A. is not responsible for any loss or damage that occurs in connection with the download or use of the APPLICATION, such as those resulting from failures, breakdowns, or blockages in the operation of the APPLICATION (for example, and without limitation: communication line errors, defects in the hardware or software of the APPLICATION, or failures in the Internet network). Likewise, LABORATORIO ECHEVARNE, S.A. will not be responsible for damages resulting from improper or inappropriate use of the APPLICATION by the User.

 

7. GOVERNING LAW AND JURISDICTION
The applicable law in the event of a dispute or conflict of interpretation of the terms that make up the legal texts, as well as any matter related to the services of this website, will be Spanish law.
